1. General Regulations, Scope of Application
1.1 The operator of the website www.mittelweser-tourismus.de or www.mittelweser-touristik.de (hereinafter referred to as "Internet Platform") is Mittelweser-Touristik GmbH, Lange Straße 18, D-31582 Nienburg, Managing Director: Mr. Martin Fahrland, District Court Walsrode, HRB 30828 (hereinafter "Mittelweser-Tourism"). The Internet Platform provides information and offers related to the areas of "Accommodations," "Events," etc.
1.2 These Terms of Use conclusively regulate the legal relationship between you and Mittelweser-Tourism insofar as you visit the website www.mittelweser-tourismus.de, request free brochures on our site, or use related services.
2. Content, Third-Party Services, and Contract Partners
2.1 Mittelweser-Tourism does not offer paid services on or through the Internet Platform but provides free information, informational materials, and access to third-party offers (hereinafter "Third-Party Providers"). There is no entitlement to use the Internet Platform and/or the provided content and functionalities.
2.2 For the use of external offers or services, which are marked as services of third-party providers, the respective third-party provider is solely responsible. The legal relationship between you and the third-party provider is governed independently of these Terms of Use, e.g., by the offers and/or the general terms and conditions of the third-party provider. Mittelweser-Tourism merely forwards your inquiries to the respective third-party providers and is not a contracting party if you send inquiries or accept offers. Mittelweser-Tourism does not guarantee or assume liability for the fulfillment of contracts concluded between you and these third-party providers, nor for material or legal defects. The processing of inquiries, bookings, and payments is solely the responsibility of the respective third-party provider.
2.3 To the extent Mittelweser-Tourism provides access to offers from third-party providers, it only offers the technical possibility for these providers to display their own tourism offers. There is no entitlement to use the Internet Platform in this context.
2.4. Order of Brochures, Storage of Contract Text
2.4.1 Mittelweser-Tourism offers brochures on various topics for free order via the Internet Platform. These brochures can be ordered in printed form by you. The ordering option is non-binding. There is no entitlement to the delivery of requested brochures. Mittelweser-Tourism reserves the right to reject inquiries, especially if the order quantity exceeds the usual amount.
2.4.2 Once you have found the desired brochures, you can view them in detail by clicking on the title and the [PDF] button. By clicking on the [Order Free] button, you can add your selection to the shopping cart. Clicking on [Proceed to Step 2] takes you to the order form, where you enter your shipping details. You will see an overview of your selected items. You can correct your selection by clicking [Back] and [X] to delete items or by changing the quantity. To complete the order, you must accept our Terms of Use and click the [Order Free Now] button, which sends your order to us.
2.4.3 Your order request will be stored by us until the final processing. We will send you an acknowledgment of receipt via email, along with a confirmation containing all order details and the entire contract text. You also have the option to print both the order and the Terms of Use before submitting your order.
3. Availability
A claim to use the content available on the internet platform exists only within the limits of the technical and operational possibilities of Mittelweser-Tourismus. Mittelweser-Tourismus strives for the most interruption-free usability of its services. However, technical disruptions (such as power outages, hardware and software errors, technical problems in data lines) may cause temporary restrictions or interruptions.
4. Liability
4.1 Mittelweser-Tourismus is fully liable for intent and gross negligence; for slight negligence, liability is only given in case of breach of essential contractual obligations. Liability for breach of such essential contractual obligations is limited to the typical contractual damage that Mittelweser-Tourismus could expect at the time of contract conclusion based on the circumstances known then. This does not affect liability for delay.
4.2 Mittelweser-Tourismus assumes no liability for disruptions within the network that are not caused by Mittelweser-Tourismus.
4.3 As far as access to offers from third-party providers is provided or information about them is included in our catalogs, Mittelweser-Tourismus does not check the completeness, correctness, or legality of these third-party contents and therefore assumes no responsibility or warranty for their completeness, correctness, legality, or timeliness. This also applies to the quality of third-party contents and their suitability for a particular purpose, including third-party contents on linked external websites.
4.4 The above liability limitations also apply accordingly in favor of Mittelweser-Tourismus’s vicarious agents.
5. Miscellaneous
5.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as mandatory provisions of the law of the country where they have their habitual residence are not excluded.
5.2 For all disputes arising from the usage relationship, if the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Nienburg/Weser, where Mittelweser-Tourismus is based. In this case, Mittelweser-Tourismus is also entitled to sue at the user’s general place of jurisdiction.
5.3 The contract language is German.
5.4 The European Commission provides a platform for online dispute resolution (ODR) for consumers, accessible at: https://ec.europa.eu/consumers/odr/. We are not willing or obliged to participate in a dispute resolution procedure before consumer arbitration boards. We would like to inform you that the European Online Dispute Resolution Platform (OS Platform) will no longer be available after July 20, 2025.
5.5 If one or more provisions of these terms of use are invalid, the remaining parts of the contract remain effective. If the provisions are invalid, the content of the contract is governed by the statutory provisions.
